Cheap Sky Flights Policies

Please read the following terms and conditions carefully.  You must not make any booking unless you understand and agree with the following terms and conditions. References to “us”, “we” and/or “our” in these booking terms and conditions shall mean Cheap Sky Flights (Maqsudi Travels Pty Ltd).

These terms and conditions apply to bookings you make with our consultants (over phone or by email, by visiting our office).

We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions.

Passports & Visas:

All travellers must have a valid passport for international travel and many countries require at least 6 months validity from the date of return and some countries require a machine-readable passport.  When assisting with an international travel booking, we will assume that all travellers on the booking have a valid Australian passport. If this is not the case, you must let us know.
It is important that you ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility (except to the extent caused by fault on our part).

Our consultants can also obtain more specific information from an external visa advisory service provider on your behalf (if you wish, we can assist you to obtain visas through this external service and fees will apply). For online bookings, you can contact an external visa provider such as Visa Central (http://au.visacentral.com/109501) directly. We do not warrant the accuracy of information provided by any external service and accept no liability for any loss or damage which you may suffer in reliance on it (except to the extent caused by fault on our part).

If you are travelling to the United States please see https://esta.cbp.dhs.gov for important information regarding compulsory pre-registration for their visa waiver program (“ESTA”). Australian passport holders will not be able to enter the United States without a valid ESTA (or visa). Please note, you may not meet the eligibility requirements of ESTA and may be required to obtain a visa.

Travel Insurance:

We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. Travel insurance is also strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel.

You must read the Combined  Financial Services Guide/Product Disclosure Statement before you decide to buy the travel insurance product you are considering purchasing to ensure it meets your needs and financial situation.

Travel Advice:

We recommend that you contact the Department of Foreign Affairs and Trade or visit their website at www.smartraveller.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to the destination you wish to visit. You can also register your travel plans with DFAT, so that you may be more easily contacted in an emergency.

Health:

You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel and ensure that you carry all necessary vaccination documentation. In some cases, failure to present required vaccination documentation (e.g. proof of Yellow Fever vaccination) may deny you entry into a country. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel.  General health advice for the destination you wish to visit is also available from DFAT (see smarttraveller.gov.au).

Prices:

All prices are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed once paid for in full by you. Please note that prices quoted are subject to change. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes and airfare increases. Please contact your consultant for up-to-date prices.

Our Change and Cancellation Fees:

Subject to your refund and remedy rights under the Australian Consumer Law, the following change and cancellation fees apply to all bookings.

Changes to Domestic/Trans-Tasman bookings will incur a fee of $30 per passenger per booking in addition to supplier fees.

Cancellations to Domestic/Trans-Tasman bookings will incur a fee of $50 per passenger per booking in addition to supplier fees.

Changes to International bookings (excluding Trans-Tasman bookings) will incur a fee of $75 per passenger per booking in addition to supplier fees.

Cancellations to International bookings (excluding Trans-Tasman bookings) will incur a fee of $300 per passenger per booking in addition to supplier fees.

Any fees for such change or cancellation must be made via credit card and will attract the applicable credit card surcharge.

Supplier Change and Cancellation Fees:

Cancelled bookings may also incur supplier fees, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced.  Supplier fees may also apply where a booking is changed and when tickets or documents are re-issued. Where we incur any liability for a supplier cancellation fee for any booking which you change or cancel, you agree to indemnify us for the amount of that fee.  Where you seek a refund for a cancelled booking for which payment has been made to the supplier, we will not provide a refund to you until we receive the funds from that supplier.

Deposit and Final Payment

You will be required to pay a deposit or deposits when booking. Your consultant will advise you of how much that will be. All deposits are non-refundable for changes of mind or cancellations by you (subject to your rights under the Australian Consumer Law).  Final payment is required no later than 6 weeks prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking.

Payments by Credit Card and Debit Card:

Credit card surcharges of 1% for Visa and MasterCard, 2.90% for American Express, and 3% for Diner’s Club will apply when paying by credit card.

Debit card surcharges of 0.60% for Debit card Visa and 0.60% for Debit card MasterCard, will apply when paying by debit card.

You authorise us to charge all fees incurred by you in relation to the services provided to the credit card or debit card designated by you. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due immediately on demand.

Payments via PayPal:

An additional 1% fee will apply when paying by PayPal.

Payments by Cheque

Please note that cheque payments (excluding bank cheques) require about 5 business days to process. If you are paying by this method you will need to make the payment at least 5 business days prior to the actual due date. You agree not to stop payment of the cheque even when you cancel a booking. You agree that we may apply the proceeds of the cheque to satisfy any liability you have to us, including any liability in respect of cancellation fees, before refunding the balance to you.

Taxes:

Airline taxes are subject to change and are confirmed at the time your airline ticket is issued. There may also be a local tax charged at some airports.

Service guarantees:

Our booking and advisory services come with a guarantee that:

they will be provided with due care and skill;

they will be reasonably fit for the specified purpose;

they can reasonably be expected to achieve the desired result; and

they will be provided within a reasonable time.

If we fail to meet any of these guarantees, you have rights under the Australian Consumer Law.

Agency:

We act as an agent for, and sell various travel related products as agent on behalf of, numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators, as well as all of our wholesalers. Any services we provide to you are collateral to that agency relationship. Our obligation to you is to (and you expressly authorise us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We exercise care in the selection of reputable service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties.  All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers.  We can provide you with copies of the relevant service provider terms and conditions on request.  Your legal rights in connection with the provision of travel services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us.  Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.

Liability:

To the extent permitted by law, neither Cheap Sky Flights nor any of its related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part.

Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law).  This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).

Special Requirements:

Please liaise with your consultant regarding any special requirements you may have for your travel arrangements such as special meal and seating requests, room type or disabled access.

Frequent Flyer:

When booking with one of our consultants, please let them know your frequent flyer membership details (or other applicable loyalty program details) for inclusion in your booking. Please check your frequent flyer program (or other applicable loyalty program) for the specific terms of your membership. We cannot guarantee that the supplier will credit you with points for your booking.

Travel Documents:

Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider.  Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees.  Travel documents cannot be transferred to another person to use.  All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled.  Please review your travel documentation carefully and advise us immediately of any errors in names, dates or timings. If you have booked with a consultant, it is your responsibility to collect all travel documents from us prior to travel. As a general rule your travel documents will be available for collection 2 weeks prior to departure, however this will depend on your individual arrangements. Please contact your consultant to confirm when your travel documents are ready for collection.  If you have booked online, you should print out and retain your travel documents as provided to you by the website (or in a follow up email we send you).

Schedule Changes:

We recommend that you contact the airline to confirm your scheduled departure time 24 hours prior to your flight.

Monies Not Held On Trust:

All monies paid by you to us will be the property of Maqsudi Travels Pty Ltd and will be a debt due and payable to the travel service provider once the services to which the money relates have been provided. You agree and acknowledge that such monies will not be held by us on trust for and on behalf of you and we may hold such monies in any account as we see fit, including with our own and/or other customer monies.

Governing Law:

If any dispute arises between you and us, the laws of Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Australia, and waive any right that you may have to object to an action being brought in those courts.

Privacy Policy:

We are committed to protecting your personal information and agree to handle your personal information in accordance with our Privacy Policy. By providing personal information to us, you agree that our Privacy Policy will apply to how we handle your personal information and you consent to us collecting, using and disclosing your personal information as detailed in our Privacy Policy.  In particular, you agree that in certain circumstances (such as where you request us to book international travel for you), we are permitted to disclose your personal information to overseas recipients.  Such recipients may include the overseas travel service providers (e.g. airlines, accommodation or tour providers) with whom you make a booking.  These travel service providers will in most cases receive your personal information in the country in which they will provide the services to you or in which their business is based.  We may also disclose your personal information to our overseas related entities and to service providers who perform services for us within and outside of Australia.  Generally, we will only disclose your personal information to these persons in connection with facilitation of your travel booking and/or to enable the performance of administrative and technical services by them on our behalf. Where we disclose your personal information to any person (including any overseas recipients), you agree that we will not be required to ensure that person’s compliance with Australian privacy laws or otherwise be accountable for how they handle your personal information. When used above, “disclose” includes to transfer, share, send, or otherwise make available or accessible to another person or entity.

Acknowledgement:

You acknowledge that you are 18 years of age or older and that you understand and agree with the above Booking Terms and Conditions and our Privacy Policy.

Privacy Policy

This Privacy Policy explains how Cheap Sky Flights and its related bodies protect the privacy of your personal information. This policy is applicable to our websites, promotions, email communications, log-in accounts and any other services operated by us .We are firmly committed to guarding the privacy and confidentiality of your personal information.

You concur to this privacy policy on how we handle you personal information by providing your personal information to us (or allowing another person to do it on your behalf). If you disagree with any part of this Privacy Policy then you must not provide your personal information to us as a result of which we will not be able to offer our services to you.

What is Personal Information?

Personal information is the information by which an individual can be identified or an opinion, including the information or an opinion whether true or false or can reasonably be ascertained, from the information or opinion.

How do we collect personal information?

Your personal information is collected directly from you when you connect to us by telephone, e-mail or when you visit our website and fill up a form related to a travel inquiry, newsletter, feedback, surveys or other product and services.

In some circumstances, when a third person is making travel arrangements on your behalf it becomes necessary for us to collect your information. We presume that it is done by your consent. Inform us immediately if you get to know that this information has been provided to us without your prior consent.

What personal information do we collect from you?

We collect all the necessary information required to facilitate your travel booking i.e. your name, telephone number, e-mail address, residential address, mailing address, credit card details, passport details, information related to your dietary requirements and health issues you are facing (if any) or other details related to your travel process.
Under some circumstances such as when you are submitting a feedback, participating in a survey or competition, we may collect your personal information.

Under some rare circumstances we may collect your personal information regarded as sensitive information. We will collect it only with your consent.

How do use your Personal information?
The primary purpose of collecting your personal information is to assist you with your travel arrangements or other related process. However it may differ on circumstances as disclosed in the policy.
We may use your information to inform you about the ongoing promotions (related to Cheap Sky Flights and its other bodies) via e-mail but you can opt out from it anytime by clicking on to the unsubscribe link. We may also use your information in market research, analyzing trends, gauging customer satisfaction and seeking feedback, accounting and other purposes permitted by law.

We may need to disclose your personal information if requested by a governmental or law enforcement authority for any reason. Such reasons may include: fraud or bring legal action against someone who may be causing, or who may be threatening to cause interference with, or damage to our rights, or properties, whether intentionally or otherwise, or when anyone else could be harmed by such activities, this includes breaking the Law.

Cookies

We use cookies, small piece of information stored on a user’s computer which helps us in analyzing and tracking the effectiveness of our marketing activities.

If you reject cookies you may still have access to our website but your access to some areas of our website will be limited. We may use other technologies to collect information about your activities and interest to provide you the targeted advertising based upon your interests.

Data Security

We provide a secure environment for the authorization of credit card transactions over the web. Client’s confidential information like credit card details is encrypted the moment they are transmitted from the client’s browser to the banking network.
Client’s credit card details are not stored anywhere on the Internet and only the merchant’s bank has access to this data. Bank also sends the confirmation information back to the client’s browser via same encrypting technology

We regularly review our security and encryption technologies and always make sure to protect your personal information in a safe environment.

Changes to our policy
We may update our Privacy Policies time to time. We reserve the right to change our Policy at any point of time and for any possible reason. All the changes will be posted on our website.

ONLINE TRANSACTION BOOKING FEES

For most airfares purchased online, Cheap Flights Flights recommended booking service fee is approximately $25 per person on all passenger type tickets for both domestic and international travel. This fee may vary and is subject to change without notice. Total Final price reflected is the actual amount to be paid which already includes any updated fees and discounts. You have the right to not make the purchase if the total amount is not acceptable.
Billing: Your credit card maybe billed in multiple charges not exceeding the total amount. All transaction service fees are 100% non-refundable.
 Service Fees – No representations are made for the service fees charged. It is only for Site usage and booking creation. No representations are made for service fees charged for booking through our call center and those fees may be higher. There are no representations or warranties except for using our call center agent’s assistance in searching various airfares and other travel products and making the booking. All types of service fees may change at any time and the most updated fees may not be reflected here.

CHANGES TO FLIGHTS ALREADY PURCHASED

Any and all changes made to the itinerary are restricted and are subject to airline fare rules, whichever is more restrictive; most of our tickets,hotels,packages and cruises do not allow any date or name changes after the booking is completed. Cheap Flights Flights does not guarantee, and shall not be responsible for, any bookings or reservations made or confirmed to you in the event that the original itinerary has been changed by the supplier pursuant to customer’s request or supplier’s schedule changes.
EXCHANGE FEES
For any itineraries where changes are permitted, an exchange/change fee is charged by Cheap Flights Flights (Cheapskyflights.com.au) plus airline penalties and any fare difference. Please contact our call center to determine the total cost of exchanging your ticket. (These fees are subject to change without notice, the latest updated fees will be provided by the agent on the call.)

CANCEL AND EXCHANGE

Most of our airline tickets are 100% non-refundable*. In certain cases where the airline may allow cancellations, a credit may be valid towards a future ticket purchase by the same traveler with travel on the same airline. An applicable penalty and a fare difference (if any), will be added in these cases. Usually the credit issued by the airline supplier is valid with time constraints and a specific expiration date and should be discussed with a customer service agent. All such bookings where the cancellation may be permitted must be cancelled prior to the scheduled departure time of the first flight segment by calling our customer service center. We do not guarantee any cancellation. A cancellation fee,as specified by the agent must be paid to us at the time of cancelling the booking; we retain this fee. The credit will be held for a limited time period, please ask the customer service agent for the specific date by when you must use this credit or you will lose the credit amount. When you are ready to make the new booking, you will have to the pay fare difference (if any), applicable airline penalties for that fare and Cheap Flights Flights’s exchange fees. All such changes are governed by the airlines’ rules and regulations and are out of our control. Cheap Flights Flights does not provide any representations or guarantees on changes or fees. If you are cancelling the booking and applying for a refund please read our Refunds Policy. Read more about our Change Policy if you wish to exchange the tickets for new dates or routing.
No additional representation is made for our exchange fees except that an agent will assist you in locating your desired new flights and attempt to re-book the new flights based on availability and other factors.
*Some refunds on tickets are also dependent on the policies(Fare Rules) of the Airlines applicable on the time of booking.

MULTIPLE AIRLINE ITINERARIES

If your Itinerary consists of more than one airline, therefore two separate fare rules will be used, different rules and policies (for example, for baggage fees, change fees, and refunds) may apply in each direction or for each airline. For changes, refunds, exchanges, each airline may charge separately. In case of Schedule change or cancellations: if your initial flight is cancelled or the schedule is changed by either you or the airline, the other airline with which you booked your return flight is not obligated to issue a refund or change your itinerary. You are responsible for complying with each airline’s terms and conditions, which may differ (for example, check-in times and limits on baggage size/weight). It is advisable you print your outbound and return portions of your e-ticket confirmation for all flights prior to travelling. You may be asked for proof of your return ticket at check-in.

CANCEL AND REFUND

Most of our airline tickets, hotels, pre-paid car rentals, vacation packages and service fees are non-refundable. All cancellations must be done over the phone only. We can accept refund requests only if the following conditions have been met:
you have applied for a cancellation and refund with us and if the fare rules provide for cancellation and refunds;
you are not a “no show” (most “no show” bookings are in-eligible for any waiver from suppliers for refund processing); and
we are able to secure waivers from suppliers to process this requested cancellation and refund.
We are unable to provide a specific time line for how long it may take for this requested refund to be processed. All refund requests are processed in a sequential format. Once you have provided our customer service agent with your cancellation request, we will then send you an email notification that your request has been received. This notification does not automatically qualify you for a refund. This only provides you with an acknowledgement of your request and provides you with a tracking number. Upon receipt of your request we will work with the suppliers such as airlines, hotels, car-rental companies to generate a waiver based on airline and other supplier rules and notify you of the supplier decision. Our services fees associated with the original travel reservation or booking are not refundable. Please note that we are dependent on the suppliers for receiving the requested refunds. Once the refund has been approved by the supplier it may take additional time for this to appear on your credit card statement. Generally, all suppliers will charge a penalty for refund. The amount will be refunded via same source. This entire process may take 4 to 6 weeks from receipt of your request to receiving credit on your statement. Apart from the airlines and other suppliers refund penalties, Cheap Flights Flights will charge a fee for processing this $50-$200. All refund fees are charged on per ticket per person basis. These fees will only be assessed if a refund has been authorized by the supplier or a waiver has been received and when the airline/supplier rules permit such refunds. If such refund is not processed by the supplier, we will refund you our fees that may have been charged to you for such refund processing, but not our previously charged service fees for the original travel reservation or booking.
